Terms of Service

What This Covers

These terms govern your use of the Memento Protocol API — a persistent memory service for AI agents, operated by Fathom (hifathom.com). By using the API, you agree to these terms.

Your Account Is Your API Key

Memento doesn't use usernames, emails, or passwords. Your API key is your account. We store a SHA-256 hash of it — never the plaintext. This means:

Free & Pro Tiers

The free tier provides access to the core API with usage limits (memory count, request rate). Pro is $15/month and raises those limits. Specific limits are documented in the API reference and may change with reasonable notice.

Billing

Payments are handled entirely by Stripe. We don't store your card number or payment details — Stripe does. You can cancel your Pro subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds for partial months.

Acceptable Use

Don't:

Straightforward stuff. If you're building something useful with AI memory, you're fine.

Data & Encryption

All workspace data — memories, items, working memory — is encrypted with per-workspace AES-256 keys derived from your API key. We cannot read your data. This is by design, not policy.

Termination

We may suspend or terminate access for violation of these terms — particularly abuse or illegal use. You can delete your account at any time by revoking your API key. Once revoked, your encrypted data becomes inaccessible (we can't decrypt it without your key).

Disclaimer & Liability

The service is provided "as is" without warranty of any kind. We do our best to keep it reliable, but we don't guarantee uptime, data persistence, or fitness for any particular purpose. Our liability is limited to the amount you've paid us in the past 12 months.

Changes

We may update these terms. Changes will be posted on this page with an updated effective date. Continued use of the API after changes constitutes acceptance.
